Aalzheimer's And Durable Power of Attorney

My Mother has alzheimer's, and I've been taking care of her for the last 8 months. Can I have her sign a durable power of attorney or is it too late? She knows I'm her son but her short term memory is gone.

Adjudication of Mental Incapacity

Florida Statute 744.3101 governs the laws and rules surrounding petitioning the court to have someone ruled mentally incompetent. Please continue your research, reading this statute may be a good starting point. I believe that, in general, someone is considered mentally competent until a judge has ruled otherwise.
