Deposition Steps

The first step is to prepare and file a Notice and Subpoena for Deposition. The opposing party has 10 days after filing to object to the issuance of a subpoena. If there is no objection filed, then a subpoena can be issued. For pro se litigants, the clerk of court signs the subpoena.

Included on the subpoena are the time and place to take the deposition. See: RULE 1.310 DEPOSITIONS UPON ORAL EXAMINATION for more information.
