Visitation/Time Sharing and Child Support Obligations
by: Anonymous

The statutes were changed about 18 months ago and it is no longer called "visitation", but rather it is called "time sharing". How much time sharing a non-custodial parent spends with their children does factor into the child support obligations in certain instances, such as: If a parent has at least 40% of the OVERNIGHTS with the child(ren), the child support obligation can nearly be a wash.

Child Support Issue

Firstly, child support has nothing to do with your visitation. How much or how little you visit with your children does not increase or decrease your child support obligation. Second, child support in the state of Florida is determined by a child support guideline based on a percentage on each parents ability to pay. Be sure you answer his petition, include an updated financial affidavit which will reflect your income and expenses. Appear at the hearing! You can speak for yourself. You cannot pay what you do not have.
Good luck!
