Motion to Dismiss; Answer to Motion for Contempt

Hi Valeria,

You have not given enough information for us to provide a very thorough answer. However, we can try to give you a starting point for your own further research.

First of all, if you were not properly served, the simplest thing to do may be to file a Motion to Quash instead of answering his Motion for Contempt. The Motion to Quash states exactly that -- you were not served properly, therefore you do not need to answer. He will likely then have you properly served, but it may counteract his effort. However, if you were served properly and fail to answer that could come back on you as a Default Judgment.

The rules regarding service of process are in Florida Statues Chapter 48. We cannot be sure whether or not you were served correctly or not, based on the information given.
