Restitution unpaid. How would I proceed in getting wages of defendant garnished?

I was awarded restitution and the defendant hasn't paid. What steps would I take to to try to get her wages garnished to pay these owed monies? Also, can i recoup monies paid trying to bring this matter to resolution?

Hi Judith,

You never said what the circumstances were for receiving the restitution.

Was it for domestic violence?
Is the the person on probation?
Does she have to pay the restitution as part of conditions to satisfy the court?

Does this person own a house?

If she does, you can file a Claim of Lien and attach it to the house. The form is at Office Depot. You fill the form out and file it at the recorders office in your county.
This will put a lien on the house. Of course you will only see the money if she sells the house.

civil judgment

Hi Judith,
I'm not an attorney, but I think you will first need to have the restitution reduced to a civil judgment. Then you recover on the judgment as an ongoing wage garnishment. You have the employer served with a motion for wage garnishment,and the employer is then required to take monies from his wages and forward to you. Look up Florida statute 77.
