FALDP FREEDOM CONFERENCE - 2023

Agenda

  • 9 – Meet and greet;
  • 9:30 – Chardo Richardson – Commercial speech and free speech. What is protected in commercial speech, how are the protections different from an individual's speech?
  • 10:30 – Scott Hedrick – Legal access and free speech. How does our right to free speech support our right to access the legal system?
  • 11:30 – Ruth Tick – Free speech, UPL, and case law. How should legal document preparers exercise their right to free speech as related to our profession? What case law supports us? What case law hinders our right to free speech?
  • 12:30 - Lunch break
  • 1:30 – Attendees break into small groups. Each group is given an assignment.
  • 3:00 – Group leaders present their solutions and ideas to the larger group.
  • 3:30 – Growth. Should we push to dominate Florida?
  • 4:00 – Fun, games, awards, and prizes.

    The agenda is also posted on our site. Each registrant will receive a Conference InfoPack a few weeks ahead of the conference.

    Our 14th Annual Conference is on September 9, in Daytona Beach, FL. Once again we will be holding it at our favorite little timeshare resort - the

    Fountain Beach Resort - DB The resort has generously offered accommodations for attendees at only $89. per night. Don't forget - space is limited. Register early to make sure you're not left out.

    This year's conference theme is Freedom of Speech. We enjoy many freedoms in the United States, so many, in fact, that we might take our freedoms for granted. Simple things, like expressing disagreement with government, worshipping as we choose, and starting our own businesses are part of the fabric of American life. People in other countries may not enjoy as many freedoms as we do, and its important to take pause to be grateful.

    Full bios of our speakers are available on our conference-info page. Register soon if you're coming. Seats are limited. Registration is available now on our Annual-Conference page. There is an option to register and pay for the conference fee for current members; and another option to register and pay for the conference for new members. Please don't confuse the two.


    How to get MORE FALDP referrals.

    To be clear, FALDP is a trade association not a list service. However, we do distribute referrals to our members as consumers request services. We do our best to match up the consumer's request with a document preparer or preparers who may be able to help.

    When a consumer call in on the 800# and requests document preparation help. We talk to them long enough to find out what they need, where they are, and whether they are articulate enough to be able to appear in court if necessary. When a consumer calls in we then refer the consumer to 2-3 members. We give the consumer the name, phone number, and sometimes the email address of the document preparers.

    When a consumer submits a contact form, we also try to match the consumer up with a document preparer. When the consumer submits a contact form, we forward that contact form to a member we think is a good fit for the consumer. And we always add: "Hi, This is an FALDP referral. Please contact the customer and acknowledge receipt of this referral within 24 hours." We need to know whether the document preparer saw the referral and is available to contact the consumer.

    Every contact from a consumer to our site is a cry for help. We need to know that one of our members is contacting that consumer and offering the help. The help that the consumer may be desperate for. And every contact that becomes a referral and sent to a member is potential income. Sometimes hundreds of dollars. Sometimes a referral turns into repeat work. You never know. When you receive a referral contact them by phone, follow up with an email, and possibly a second email and a second phone call.

    PERSISTENCE.

  • Make sure the information on your site listing is up to date and accurate.
  • Make sure you have added your information to the county directory.
  • Answer your phone.
  • Join the FALDP Facebook group. Sometimes we post doc prep requests there.
  • Join Florida Pro Se Help group on Facebook. We created this group during the pandemic to help the confused consumers and pro se litigants understand the new procedural rules. Now, more and more consumers are asking for document prep help there.
  • Engage with FALDP and make sure that your Director knows what services you provide.

  • Attorneys Contacting Members

    Recently we have been told that attorneys have contacted members for document preparation services. FALDP has no policy against members also working as paralegals. It is completely acceptable to work as a contract/ freelance paralegal and work in your own business as a legal document preparer. However, there are a few important things to remember.

  • NEVER EVER EVER share fees with an attorney. For example, do not take in work from a consumer and include a fee for an attorney consultation in the initial fee.
  • Do not pay an attorney a referral fee for work he referred you; and do not accept payment for work you refer to an attorney.
  • FALDP members may not form a business partnership with an attorney. A member and an attorney may refer work to each other, but not work as partners. (Referrals without referral fees, of course.)
  • If an attorney you don't know contacts you and requests that you provide document services for him, ask questions:

  • 1. How is the work to be paid, hourly or flat fee?
    2. Ask to see the independent contractor agreement before doing any work.
    3. Find out how soon you will be paid after you complete a document preparation task or project.
    4. Find out why the attorney does not hire a paralegal as a W2 employee instead of you.


    RENEWAL PERIOD ENDED

    July 31 was the last day to renew FALDP membership.

    Lapsed members may rejoin by submitting a new Membership Application and submitting payment for $166.

    Members should check the All member-directory to make sure all their information is correct. The information on the All Member Directory is taken from the Membership Application. If you have a new website, please be sure to let us know so that we can link it to your listing.

    Avoid UPL! Course - REMINDER

    Don't forget. New members should take the Avoid UPL! course within 30 days of joining. We require all members to take the Avoid UPL! Course each year. We add, or edit some content throughout the year, but make no effort to entertain members with all fresh and new information.

    We hope members will internalize the main points through repetition. In addition, you may discover something new that had not caught your attention before. We admit that some of the information seems trivial. Learn it anyway. Your goal is to Avoid UPL, you don't need to agree with all of the rules.

    Zoom Meetings

    The Zoom scheduled for the last Saturday of this month (8/26 @ 11:00 am EST) is "Taking Your Business to the Next Level". Members can get ideas about how to grow their businesses regardless of where they are now. The information at this meeting will benefit you whether you are just starting out, or seeking to grow your business. Attend if you can, you'll be glad you did.
    Remember, our Saturday conferences are valued at one continuing education unit.

    Our After Hours Zooms are held the second Tuesday of each month at 6:00 pm EST.     FALDP Private Facebook Group

    About one third of our membership has joined the FALDP private Facebook group. We created it to make it easier to interact with each other. So far, people have given work referrals to one another; asked questions to the group; received help in locating a form; and discussed various issues. If you're working toward FALDP Certification, you earn one CEU just by joining the group. So, what are you waiting for?
